How long do I have to settle my case or bring a lawsuit after a car accident?
As a general rule, but there are always exceptions in the law, a two year statute of limitations applies. Failure to either settle or bring a lawsuit within the applicable time period bars any claim that you may have from being brought in the future.
I have been in a car accident and the driver at fault does not have liability insurance. Can I still recover for my injuries?
If you have uninsured motorist insurance, you may still be able to recover by filing a claim with your own insurance company. If the police were present at the accident scene and an official police report was filed, the driver at fault could lose his driver’s license until such time as you are paid for your loss. An attorney’s opinion should always be sought to determine if alternative sources of recovery are available, such as employers or third parties
How long will my case take?
Each case is different and the timeframe is dependant on your particular facts and circumstances. In most cases no settlement should be obtained until full medical improvement and stability are certain. At that time, a physician’s narrative report is obtained for use in negotiations with the liable party or insurer.
How am I going to be able to pay for an attorney to help me with my case?
We take cases on a contingent fee basis. The contingent fee entitles us to a certain negotiated percentage of your recovery. The attorney will advance the expenses of the case and in the event that the case is settled or won, you will be responsible for repaying the attorney the expenses advanced and the contingency fee. There is no cost to you unless we recover.
How am I going to pay for my doctor and hospital bills?
You may be able to use your own health or medical disability insurance or that of your employer. In the event that you do not have insurance, sometimes a letter of protection, drafted by an attorney, can be accepted by your physicians to cover your medical bills until your case is won or settled.
